Contest participation rules

1. Organiser

The organiser of the contests announced on the pages and in the app of RADIO 001 is METROPOL FM GmbH, Potsdamerstraße 141, 10783 Berlin, Deutschland. Further details are set out in the imprint.

By taking part you accept these participation rules and, in addition, our terms of use. Individual contests may announce deviating or supplementary rules in their respective entry page; those take precedence.

3. Entry period and how to enter

The entry period is stated in the respective announcement. Entries received after it ends are not considered.

You enter by pressing the participation button on the respective contest while logged in. Only one entry per person and contest is permitted.

4. Free participation

Participation is free of charge. It is not tied to the purchase of any goods or services. No costs arise beyond the usual connection charges of your internet access.

5. Determination of the winners

Winners are determined by the organiser after the entry period ends — depending on the announcement, either by a draw among all valid entries or by decision of a jury. There is no notarial supervision and no involvement of witnesses unless the announcement states otherwise.

6. Notification and claiming the prize

Notification is sent to the email address stored in your member account. Please keep this address up to date and also check your spam folder.

If a winner does not respond within 14 days of the notification being sent, the claim to the prize lapses. In that case the organiser is entitled to determine a new winner.

7. Nature of the prize

The prize is granted solely in the form announced. Payment in cash, exchange or transfer of the prize to third parties is excluded. Any taxes and ancillary costs associated with the prize are borne by the winner, unless the announcement provides otherwise.

8. Prize delivery and address data

To ship a physical prize we need your name, postal address and, where applicable, a telephone number for delivery. You provide this data voluntarily and on the basis of your separate consent. It is used exclusively to process the prize, passed on only to the transport company commissioned with delivery, and deleted once delivery is complete, unless statutory retention obligations apply.

9. Exclusion from participation

The organiser may exclude participants and revoke prizes already awarded if these rules are breached. This applies in particular to the use of several accounts by the same person, the use of automated tools (bots, scripts), and false or incomplete personal details.

10. Early termination and modification

The organiser reserves the right to cancel, end or modify a contest at any time and without prior notice for good cause. Good cause exists in particular in the event of technical faults, attempted manipulation, legal obstacles, or where proper conduct of the contest cannot be ensured due to insufficient participation. No claims arise for participants as a result.

11. Liability

The organiser is liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, and under the German Product Liability Act. In the case of slight negligence it is liable only for breach of a material contractual obligation (cardinal obligation) and limited to the foreseeable, typical damage. Within these limits, liability also applies to disruptions of data transmission, the loss of entries for technical reasons and defects of the prize caused by the conduct of third parties.

12. Data protection

Data collected in connection with a contest is processed exclusively to run that contest. Entry records are deleted automatically 90 days after the respective contest ends. Details and your rights are set out in our privacy policy; please direct questions to [email protected].

13. Legal recourse

Legal recourse is excluded. In particular, the determination of the winners and decisions of a jury cannot be contested.

14. Applicable law and final provisions

The law of the Federal Republic of Germany applies. If you are a consumer habitually resident in another state, the mandatory consumer protection provisions of that state remain unaffected. Should individual provisions of these participation rules be or become invalid, the validity of the remaining provisions remains unaffected.
